Police: Man struggles with burglars, fires shot

Sources tell 7 Eyewitness News a retired Buffalo Police reserve officer was taken to Erie County Medical Center after an apparent burglary on Florette Drive West in Cheektowaga.

Police responded to 13 Florette Drive West around 3:30 a.m. after a report of shots being fired. Police say the homeowner is a man in his 60s.

Police say he claims to have woken up because he heard something in his driveway and when he went to check, he saw four white males trying to break into his garage.

Police say the homeowner claims he tried stopping them and an altercation ensued.

"He claims that they assaulted him with a baseball bat and a shot rang out and he returned fire," said Assistant Chief Jim Speyer. "He has a valid pistol permit."

Police say the homeowner wasn't shot but was taken to the hospital for observation. They don't believe anyone else was hurt.

Police continue to investigate the incident.
