BUFFALO, N.Y. (WKBW) — David Yax of North Evans is Western New York's newest millionaire.

On Tuesday, he collected an $80 million jackpot from the September 4 Powerball drawing. New York State Lottery icon Yolanda Vega presented the check at the Tops Friendly Markets in Derby, where Yax purchased the ticket.

Yax says he checked his ticket early one morning, then woke up his wife to tell her about it. A bar code scan from a lottery ticket checker confirmed he had won.

As many know, a $80 million jackpot does not mean $80 million in the bank. In this case, Yax opted for the one-time lump sum payment. After withholdings, he's collecting $38,498,567.

Yax says he and his wife plan to set up a trust to invest, then travel and "just have fun."

This jackpot is the largest lottery win in Western New York history, surpassing the previous record set in 1991 ($33.3 million).
