KENMORE, N.Y. (WKBW) — A Kenmore family has filed a lawsuit against Fisher-Price Inc. and Mattel Inc. in connection with the death of their child.

According to the lawsuit, the Fisher-Price Rock'n Play Sleeper was defectively designed, manufactured, tested, marketed and sold by Fisher-Price and/or Mattel.

The child died on January 6th, 2018 while in the process of utilizing the Rock'n Play Sleeper as a result of positional asphyxia, according to the lawsuit.

The U.S. Consumer Product Safety Commission recalled 4.7 million Rock'n Play Sleepers in April. According to the CPSC, Rock ‘n Play Sleepers have caused at least 30 infant deaths since 2009.

A class-action lawsuit filed in April in Buffalo claims that the East Aurora toy company knew about the risks to babies for years and ignored them.
