BUFFALO, N.Y. (WKBW) — Buffalo police say the driver of the vehicle involved in a rollover crash that killed a woman in August is now facing charges.

The crash occurred just before 6 a.m. on August 3rd on the 300 block of Memorial Drive, which is a few blocks away from Buffalo's Central Terminal.

An SUV driven by a 27-year-old Tremayne D. Brooks of Buffalo was traveling northbound on Memorial when the vehicle veered off the road and struck a tree and rolled over.

A 42-year-old female passenger Toni Abernathy of Buffalo was pronounced dead at the scene.

Brooks, who was transported to ECMC to be treated for non-life threatening injuries, is now being charged with: vehicular manslaughter, DWI, aggravated unlicensed operation of a vehicle and other charges.

Police say a passerby witnessed the crash and attempted to help Abernathy and Brooks when Brooks exited the vehicle and attempted to flee on foot. Due to his injuries he fell to the ground a short distance away.
