7 Eyewitness News has learned a federal judge will need more time to decide if charges will be dismissed in the case against officer Corey Krug.
The judge was expected to make a decision earlier this week but a recent order shows the judge needs more time.
Krug is the Buffalo police officer, recorded by a 7 Eyewitness News photographer, storming up Chippewa Street, hitting a man on the ground with his baton. As a result, Krug is charged with federal civil rights violations.
Krug's attorney, Terry Connors, wants some, if not all, charges dropped.
The judge says he is making "substantial progress" toward a decision. A judgment will be issued by March 21.
Krug is suspended with pay.
