Afghan soldier caught at border due in court

One of the three Afghan soldiers arrested when trying to cross the border is back in court on Tuesday.

Maj. Jan Mohamad Arash is set to be back in U.S. Immigration Court at 1 p.m. in Batavia.

Arash along with two fellow Afghan soldiers tried to cross the Peace Bridge back in September. The three soldiers were stopped by border officials.

Once Canada denied their entry, they were sent back to the United States.

All three soldiers say that if they are sent back to Afghanistan, they'll be killed, or at the very least tortured by the Taliban.
