Hate crime case going to grand jury

A grand jury will review the case of a black teenager charged with a hate crime after he allegedly shot a white man last week in Lockport.

Josiah Chandler, 19, appeared in court Monday where he waived his felony hearing. Chandler is accused of saying to 20-year-old Colton Baker Durst, "You're gonna die tonight" before witnesses day he pulled out a .38 caliber handgun and shot him multiple times.

Police found Baker Durst lying on the ground near Church and Grand Streets. He was taken to Erie County Medical Center where he has been listed in critical condition.

Lockport Police said their investigation showed Chandler, who is black, shot Baker Durst, who is white, because of his race.

Chandler's attorney declined comment Monday but said Chandler may still be eligible for youthful offender status, which goes up until age 19.

Chandler is being held in the Niagara County Jail on $250,000 bail.
