Two lawsuits have been filed in a U.S. federal court in Albany, against a Canadian truck driver whose rig slammed into a police cruiser, killing an officer on the New York State Thruway.

Both the estate of deceased state trooper David Cunniff, 35, and the driver he pulled over before the fatal crash last December, are suing Gary Blakley, 65, of Ridgeway, Ont., and the company he worked for.

Both lawsuits allege Blakley was negligent.

He was not charged at the time and was allowed to return to Canada.

Montgomery County District Attorney Jed Conboy tells the Schenectady Gazette that a grand jury has met to consider evidence in the case and has concluded its work. He declined to elaborate.
