The teenage driver involved in a fatal accident at an East Aurora Tops parking lot will not be facing criminal charges. The 18-year-old man was backing up in the parking lot on June 26 when he hit and killed 48-year-old Wendy L. Bus of Colden, according to police.
East Aurora Police decided no criminal charges will be filed after conferring with the Erie County District Attorney's Office.
The driver still faces NYS vehicle and traffic law violations including unsafe backing, failure to exercise due care and unsafe start.
