A Batavia woman is accused of talking about a grand jury decision before it was officially filed and made public.

Janice Mortellaro, 62, is charged with unlawful grand jury disclosure, a Class E felony.

Authorities say she was a member of a grand jury in Genesee County that was seated on December 8th to hear testimony in a homicide case. After hearing testimony, Mortellaro allegedly revealed to an acquaintance that the grand jury had decided to indict in the matter prior to the decision being filed and made public.

The decision was to indict Kyle Johnson, who allegedly murdered his neighbor in LeRoy before setting his own house on fire.

Mortellaro is due back in court next month. If convicted, she could face up to four years in prison.
