Man allegedly tried to use straw purchaser

A man is accused of trying to use a straw purchaser to buy a shotgun after refusing to fill out a form required for a federal background check.

Deputies in Orleans County say John Klotzbach went to a local gun shop and wanted to buy a shotgun but refused to complete ATF Form 4473, which is required. The 66-year-old’s application was denied.

Several days later, the gun store owner became suspicious when a woman, who was riding in Klotzbach's vehicle, came into his shop wanting to buy the same shotgun.

Deputies were called and Klotzbach was later arrested. He’s charged with fifth degree conspiracy as well as felony third degree criminal possession of a weapon. When he was taken into custody at his home on Ridge Road in Albion, deputies say they found a sawed off shotgun.

Klotzbach is being held on $10,000 bail.

At this time, the woman who tried to buy the shotgun for Klotzbach has not been arrested. But deputies say the investigation is still ongoing. Further arrests and charges are pending. Klotzbach may also face federal weapons charges.
