A legally blind man is dead after being struck by a car over the weekend in Batavia.
Joseph Ogozaly, 58, was crossing Main Street around 7 p.m. on Saturday when he was struck by a vehicle driven by 78-year-old Robert Christner of LeRoy.
Ogozaly was crossing with the light and in the crosswalk. He was using a white reflective metal cane with a red tip that indicated he was visually impaired.
Christner is charged with failure to yield the right of way to a blind or visually impaired person in a crosswalk and for having an expired state inspection.
Police say the investigation is ongoing and they are waiting on additional information.
