The family of Dana Papaj, the woman critically injured after a hit and run on Grand Island, is preparing to take legal action against the Town of Grand Island and Erie County.
The attorney for the family tells 7 Eyewitness News that a 'Notice of Claim' has been filed against the town and county, putting them on notice that a lawsuit may be next.
Papaj, 53, remains in a coma at ECMC after being hit by a pick-up truck while walking her dog on East River Road last month.
Investigators have confiscated the truck that hit her, however no arrests have been made in the case.
