West Seneca police say a man attempted to smash the window out of a patrol car during his DWI arrest on Saturday.
According to police, Eric Luman was driving at 62 mph in a 35 mph zone, causing officers to pull him over. Police say they noticed Luman had blood shot eyes, slurred speech and smelled of alcohol.
Officers conducted a field sobriety test and arrested Luman for DWI.
During Luman's arrest, police say a passenger in the car became disorderly while officers told her the vehicle was being impounded according to the law.
After multiple warnings, police say Brittany Arvello was arrested for disorderly conduct. She was booked, processed and released to a sober third party. She is due back in West Seneca Court at a later date.
During Arvello's arrest, officers say Luman tried to smash the windows of the patrol car he was in, causing minor damage. Officers say they struggled with him and put him in leg restraints. During the struggle, one officer says he got a cut on his face.
Police took Luman to the station where he refused a breath test, according to police. He was booked, processed and released to a sober third party.
Luman was charged with DWI, aggravated unlicensed operation, speeding, obstruction, attempted criminal mischief and attempted assault. He is due back in West Seneca Court at a later date.
