A Buffalo man will spend up to five years in prison for failing to pay more than $500,000 in business taxes.

64-year-old David Schmitt pleaded guilty Wednesday to willfully evading taxes for two delivery businesses he owned and operated between February 2010 and June 2013.

Schmitt owned Three Kids Trucking, Inc. and 1553 Harlem Road Inc.

He filed false forms with the IRS, he had people open bank accounts for the businesses, and created a fraudulent trust.

Schmitt is set to be sentenced in February. In addition to a maximum of five years in prison, he faces a $250,000 fine.
