Man charged in fatal hit of road worker

A man is facing charges in the death of another man who was killed while working as a surveyor in the Town of Sardinia in July.

The Erie County Sheriff's Office says Robert Sutherland was driving eastbound on Route 39 on Wednesday, July 6, when he crossed over into the westbound shoulder and hit 22-year-old Samuel Pagano who was working on the side of the road.  

Investigators say Sutherland's car then went on to hit a tree and a utility pole.

Pagano was pronounced dead at the scene, and Sutherland suffered a leg injury.

Sutherland is charged with 2nd Degree vehicular manslaughter.
