A Buffalo man is being held in the Erie County Holding Center after an October assault of a twenty-two month old baby in the Town of Tonawanda.
Marcell Brooks, 25, was arrested on Box Street Tuesday.
Brooks arrest comes after an Erie County Grand Jury indictment from December 23, 2016.
On October 5, 2016, Town of Tonawanda Police arrived at 2676 Sheridan Drive after a report of an unresponsive baby.
Police say Brooks was babysitting at the time and told police the baby, Devyn Grabowski, fell backwards down three stairs and hit his head.
Devyn was taken to the Children's Hospital. Doctors there agreed his injuries were very serious and consistent with "Shaken Baby" syndrome.
Devyn was diagnosed with swelling of the brain and a spinal cord injury.
Brooks was ultimately charged with one court of first degree assault, two counts of second degree assault and one count of reckless assault of a child.
