CHEEKTOWAGA, N.Y. (WKBW) — A town employee accused of painting a political message on a town vehicle is now suing.

Robert Hupkowicz was suspended from his job at the town of Cheektowaga Highway Department in December of 2020, for allegedly painting "Trump 2020" on a snow plow.

Hupkowicz was later arrested and charged with criminal mischief and making graffiti.

The civil rights lawsuit alleges Hupkowicz was arrested under false pretenses, and Cheektowaga officials conspired to arrest him. According to his attorney, Hupkowicz was reinstated following his first disciplinary hearing, after being suspended for about four weeks.

The town's attorney says they do not comment on pending litigation.
