"This is not the way justice works", Family still waiting for action after Jamestown shooting

JAMESTOWN, N.Y. (WKBW) — Tony Neubauer has been in the hospital for 51 days, recovering after a shooting at a Jamestown bar. The shooter has still not been charged.

Weeks after the incident, his family called for action, starting a Facebook page called Justice for Tony. Nearly two months later, they are disappointed in authorities for what they're calling a lack of justice.

“It frustrates me because the shooter’s out there spending Christmas with his family and my son's in a hospital bed? He needs justice,” said Jane VanDevender, Neubauer's mother.

Neubauer has undergone more than a dozen surgeries. His doctors told him he may never walk again.

“We want you to walk your daughters down the aisle, we want you to play ball with your son. We want you to come back to us,” said VanDevender.

Jamestown Police are waiting to interview Neubauer, per Captain Robert Samuelson. But police say they've yet to receive a response from Neubauer's attorneys on scheduling the interview.

Chautauqua County District Attornye Patrick Swanson says the investigation is ongoing. 7 Eyewitness News reached out to DA Swanson again and have not yet heard back.
