HAMBURG, N.Y. (WKBW) — A State Supreme Court judge has dismissed a lawsuit filed by developer, AL Asphalt, regarding a controversial proposed asphalt plant on Camp Road in Hamburg.
The company was suing the town's planning board, saying the board was delaying the project from moving forward.
The judge's ruling determined the company will have to conduct a full environmental study in order to proceed with the project.
The attorney representing AL Asphalt says the company plans to appeal the decision.
