Orchard Park man charged with driving drunk, killing passenger

BUFFALO, N.Y. (WKBW) — A 33-year-old man is charged with Vehicular Manslaughter after police say he crashed a vehicle while under the influence of alcohol, killing one passenger.

According to police, 33-year-old Daniel Witczak drove and crashed and overturned a vehicle on Southwestern Boulevard in the Town of West Seneca. The crash happened Sunday morning on September 15.

Corrie Bennett, a 38-year-old passenger, was pronounced dead at the scene. Two passengers, along with Witczak, were taken to ECMC with serious injuries.

Witczak was initially arraigned on one count of Driving While Intoxicated on October 15. The 33-year-old man received additional charges after the West Seneca Police Department and the Erie County District Attorney’s Office investigated the crash.

The case will move to a Grand Jury.
