Man accused of trying to rape a rideshare driver in Cheektowaga acquitted

CHEEKTOWAGA, NY (WKBW) — A 49-year-old Cheektowaga man accused of attempted rape and sexual abuse has been acquitted.

An Erie County Court has acquitted James Krawczyk. He was accused of trying to rape a Lyft Driver and unwanted sexual contact while on Caprice Drive in the Town of Cheektowaga.

"This is the first case of its nature that has come to my attention here," Flynn said. "No matter how drunk you are, no matter what condition you may be in, this is not a joke. And if you commit a crime, I'm going to prosecute you for it."

The victim believed Krawzcyk was intoxicated at the time of the alleged rape. Cheektowaga Town Court Justice James Speyer ordered a forensic evaluation of Krawczyk.

Flynn said in no way should this freak incident deter anyone from calling from calling for a ride and that ridesharing has, in fact, had a profound, positive impact on Erie County.

Krawczyk was arraigned April 25th on an indictment charging him with one count of attempted rape in the first degree and one count of sexual abuse in the first degree.

He was acquitted on Novemer 1.
