BUFFALO, N.Y. (WKBW) — The U.S. Attorney's Office announced a federal grand jury returned a 13-count indictment charging a Kenmore man with production, receipt, and possession of child pornography, sexual enticement of a minor, and transfer of obscene material to a minor.

Officials say a parent filed a report with the Town of Tonawanda Police Department alleging 38-year-old David Rubel was texting his daughter who recently turned 16-years-old and some of the texts were allegedly sexual in nature.

With the consent of the parent a detective searched the cell phone and observed the text messages, some included sexual images according to officials.

Rubel's phone was also searched and sexual images that were also found on the victim's phone were recovered.

Officials say Rubel will be arraigned on December 23. The charges carry a minimum penalty of 15 years in prison and a maximum of life in prison.
