Erie County Clerk to sue Governor Cuomo over Green Light Bill

BUFFALO, N.Y. (WKBW) — The Erie County Clerk is taking legal action against New York Governor Andrew Cuomo, challenging the recently passed Green Light Bill.

Clerk Michael Kearns will be filing a federal lawsuit against Governor Cuomo, Attorney General Letitia James and the New York Commissioner of the Department of Motor Vehicles Marks Schroeder.

The legislation allows undocumented immigrants to apply for a driver's license in the state of New York.

The clerk's office says the legislation facilitates illegal aliens to remain in the United States and aims to shield them from detection by immigration officials. Kearns says the law compels County Clerks across the state to violate federal law.

In an interview with 7 Eyewitness News in June, Kearns said, "Any legislation has to mirror federal law. State law can't supersede federal law."

The lawsuit seeks as a declaration as the law's constitutionality and will also be seeking an injunction to prevent the law from going into the effect prior to a final decision from the courts.
