BUFFALO, N.Y. (WKBW) — An Erie County Sheriff's Deputy found guilty of assaulting a Bills fan in 2017 has submitted his resignation to the Sheriff's Office.

Erie County Sheriff Timothy Howard says while reviewing Deputy Kenneth Achtyl's employment status following the trial last week, his office received the letter of resignation.

Sheriff Howard attended every day of the trial in support of his Deputy. After the verdict, Howard blamed District Attorney John Flynn for dropping charges against Bills fan Nicholas Belsito, and releasing body camera footage of the incident.

"As a leader you're going to stick up for your guy I get that i respect that," said Flynn in defense.

Achtyl will be sentenced on January 23rd, 2020. Achtyl faces a maximum of two years in prison.
