Gov. Andrew Cuomo says he's amending his budget proposal to include a provision recognizing that arrestees can't legally consent to sexual activity with police officers.
Cuomo cited an "egregious loophole" in the current law, which prohibits sex between inmates and correctional officers, but not between police and those in their custody.
This comes after two New York City police detectives were charged with sexually assaulting a handcuffed woman in Brooklyn. The men denied the allegations and resigned.
