The driver who survived a deadly two-car crash on Route 380 in the Town of Ellery on September 2 has been arrested by Chautauqua County deputies.

Jude Gagliano, 29, of Lakewood, was arrested Monday. He has been charged with second-degree vehicular manslaughter, driving while intoxicated, and failure to stop at a stop sign.

On Friday, September 2, Gagliano's vehicle collided with a vehicle driven by 22-year-old Charles Clutter of Stockton at the intersection of Route 380 and Sinclair Drive. Clutter was pronounced dead at the scene. Gagliano was treated for injuries at an Erie, Pennsylvania hospital.

Gagliano was arraigned in Town of Ellery Court Monday night and transported to Chautauqua County Jail. Gagliano was remanded without bail while his case moves through trial.
