A Buffalo man, facing charges in connection to a shooting that injured an 11-year-old boy over the summer, has been arraigned in State Supreme Court, according to the Erie County District Attorney's Office.
Prosecutors say 21-year-old Detavion Magee was walking on Humason Avenue in Buffalo with a loaded gun when rival gang members pulled up in a vehicle and started a gunfight. During the shooting, a stray bullet struck 11-year-old Juan Rodriguez in the head as he was helping his younger siblings inside the family home to escape the shooting.
Rodriguez, who is now 12-years-old, is recovering from his injuries.
According to the District Attorney, Magee pleaded not guilty and was taken to jail without bail. He faces a maximum of 15 years in prison, if convicted of the charges.
