The District Attorney's Office announced this afternoon Marshawn Levy, 33 of Buffalo has been arraigned.

He's charged with vehicular assault and two counts of DWI, following a crash in Buffalo.

Levy allegedly operated a vehicle with a BAC almost twice the legal limit. He was headed northbound on Bailey Avenue when he struck a car that was stopped in the southbound lane to make a turn onto East Delavan Road.

The collision caused serious physical injury to the driver of the vehicle, 27-year-old Dwight Daniels of Depew and his passenger, 25-year-old Trevor Jenkins. Jenkins is still at ECMC being treated for injuries.

Levy pleaded not guilty and bail was set at $5,000.

If convicted, he faces a maximum of seven years in prison.
