Brother charged with assault following movie theater brawl

Buffalo Police are providing more detail as to what happened outside the Regal Cinemas on Elmwood early Wednesday morning that left one man with a serious brain injury.

According to police, one of the brothers jumped up and attempted to shove the Regal manager. Police say at that point, the off-duty Buffalo Police Officer ran outside and took the brother who shoved the manager to the ground, and placed him in custody.

Charges against 19-year-old Jonah Giusiana have been upgraded to felony assault after police say he caused a massive brain injury to his brother Noah during the fight.

The injury was not noticed until the brothers had spent the night in the Buffalo Central Booking Jail. Noah suffered a medical emergency around 9:00 a.m. police say and was unresponsive.

"At the lockup they were both medically screened and placed in cells. The very next morning the cell block attendant noticed the one brother was unresponsive," said Buffalo Police Lt. Jeff Rinaldo.

Noah Giusiana is still at ECMC recovering from his brain surgery. He is in critical condition, according to police.
