A Buffalo man has become the first boater of the season to be charged by the Erie County Sheriff's Office with boating while intoxicated.

Deputies with the marine unit arrested Andrew Bodack, 49, after spotting his boat in the Niagara River Monday night without the proper navigational lights. Investigators say they determined he was drunk and also had marijuana in his possession.

Bodack is charged with DWI, unlawful possession of marijuana and vessel equipment violations.

He is scheduled to appear in Buffalo City Court in June.
