Family of fallen BPD officer takes step toward lawsuit

The family of fallen Buffalo Police Officer Craig Lehner has filed a notice of claim against the City of Buffalo and the Buffalo Police Department, according to city spokesperson Mike DeGeorge.

A notice of claim puts the parties named on notice that a lawsuit may soon be filed against them.

Lehner disappeared underwater during a training exercise with the Buffalo Police Underwater Rescue and Recovery Team in the Niagara River off Broderick Park on October 13th. 

His body was recovered five days later. It was his first training dive in that part of the river. Buffalo Police say he likely got caught on somethingunderwater. 

Officer Lehner, 34, was a nine-year veteran of the BPD. He had also served in the Army National Guard. 

In addition to serving on the URRT, Lehner was also a K-9 officer with the department.
