Police continue investigation into officer involved shooting in Black Rock

7 Eyewitness News has learned the officer shot at Garfield Street and Hartman Place is Officer Joe Acquino. Officer Acquino is out of surgery and listed in fair condition at ECMC.

One person is dead after shots rang out after a traffic stop in Buffalo's Black Rock neighborhood.

Police say the incident happened shortly after 5:00 p.m. at the corner of Garfield Street and Hartman Place in North Buffalo.

At some point during the exchange, Officer Acquino was shot in the head and the suspect was shot in the arm.

Another officer involved in the incident, Justin Tedesco, 36, was treated and released from ECMC after being evaluated. Both Tedesco and Acquino joined the department in 2012.

It is unclear at this point what led up to the gunfire.

The suspect, 26-year-old Jose Hernandez-Rossy, was taken to Kenmore Mercy Hospital where he was pronounced dead.

A vigil was held in support of the officer at Hertel and Tonawanda. Buffalo City Councilmen Joe Golombek and Christopher Scanlon were in attendance. 

The dome of City Hall has also been lit blue in support of the injured officer.
