The arresting officers report 28-year-old Kyle Bak showed signs of intoxication after the crash and told them that he was texting when he drove off the road. Police report that Bak told an officer at the scene "I was drinking all day and just finished a 25-ounce can of beer."

Bak was given a breathalyzer test, which recorded a .20 BAC. He was charged with DWI, aggravated dwi, unregistered motor vehicle, and operating an electronic device while driving. Bak was held in custody on $250 bail.
