An operator of a boat registered a BAC of more than two times the legal limit after being stopped for an equipment violation.

David Finn, 27, was boating on the Niagara River near the shoreline of Grand Island on August 28 when he was stopped by the Marine Unit, according to the Erie County Sheriff's Office.

Deputies say they noticed signs of intoxication while interviewing Finn and conducted a field sobriety test.

According to officials, Finn was arrested and charged with BWI, unlawful possession of marijuana and navigational law violations.

Officials say Finn was released to a third party.
