According the most recent understanding of Sunday's incident in Black Rock, BPD Officer Aquino may not have been shot. He could have been injured by an airbag as he was trying to commandeer Jose Hernandez-Rossy’s car.

Aquino thought he was shot, but an airbag that close, may have sounded like a gunshot. Airbags deploy in 1/20th of a second.

Starting in 2013, the NHTSA recalled over 40 million cars with Takata Airbags after people were killed from the shrapnel from the deploying airbags. The car Jose Hernandez-Rossy was driving, an Acura MDX from the early 2010s, was not a part of that recall.

The lawyer representing Hernandez-Rossy’s family says he finds it hard to understand how a police officer could mistake a gun being discharged with an airbag going off.
