A retired sheriff's sergeant is accused of murder to help hide a suspected sex crime.
A Wyoming County grand jury filed an indictment against Joseph Mylniec, accusing him of murder in the second degree.
Prosecutors say he shot and killed Robert Irvine III in the driveway of the suspect's home on Route 246 in Perry.
This happened back on March 7.
Prosecutors say the motive was to keep the victim from telling police about a suspected sex crime involving the suspect.
Mylniec is also charged with the intimidation of a witness.
He's being held without bail.
