A Blasdell man is facing felony charges, after Orchard Park police say he was found passed out behind the wheel, Sunday night.

Police arrested 25-year-old Tyler Melisz, charging him with driving while ability impaired because of drugs, aggravated unlicensed operation of a vehicle, criminal possession of a controlled substance and possessing a hypodermic instrument.

Orchard Park police were called to Southwestern Boulevard at the five-corners intersection, around 7:00 p.m. Sunday.

They say Melisz was stopped in traffic and passed out. After officers woke him up, they say Melisz failed a field sobriety test.  Officers say they found a small plastic baggy with what's believed to be heroin.  They also found a hypodermic needle, according to a press release issued overnight.

While they were investigating, officers discovered Melisz had 39-suspensions on his license. Sources say those are related to minor offenses like speeding or seatbelt violations. However, sources also say he wouldn't report to court to answer to the charges, and that's when the court would suspend his license. 

Melisz was arraigned in Orchard Park Town Court and released without bail. Some in the law enforcement community are surprised to see the judge opted to let him go without setting bail. 

He's due back in court at a later date, which has not been released.
