Lockport judge leaves post amid misconduct probe

A veteran Lockport Town Justice is set to resign on Sunday amid a misconduct probe by the New York State Commission on Judicial Conduct.

Justice Leonard Tilney Jr. has been a Justice of the Lockport Town Court in Niagara County since 2004.

According to court documents, "Judge Tilney was appraised by the Commission in August 2018 that it was investigating a complaint against him, alleging that at various times in 2017, he had committed misconduct both on and off the bench, including allegations that:

• He made a culturally insensitive comment to a defendant at sentencing,

• Yelled at his co-judge from the bench in a denigrating manner using vulgarity and

• Posted racially offensive material in the office area of the courthouse.

Court documents show that Judge Tilney rendered his resignation by letter dated August 8, 2018, affirming he will vacate the office by the end of the day on September 30, 2018.
