State Senator Tim Kennedy and Erie County District Attorney John Flynn are expected to throw their weight behind the Child Victims Act in the wake of last week's bombshell report about sexual misconduct between teachers and students at Nichols School, sources tell 7 Eyewitness News.
The pair has scheduled a news conference Wednesday morning. They could also address a loophole that does not require private schools to report sexual misconduct.
The Child Victims Act, which Governor Andrew Cuomo announced he wants to pass this year during his State of the State address, would extend the amount of time victims of child sexual misconduct would have to come forward.
Under the current statutes of limitations, students from Nichols who were potential victims of sexual misconduct by their teachers would not be able to have their day in court.
The Child Victims Act seeks to eliminate statutes of limitations for all sexually-related criminal cases committed against people less than 18 years of age. Further, it would allow victims to make civil claims up to fifty years from the date of the offense.
In a press release, a spokesperson for Senator Kennedy says he and Flynn will "discuss the [Nichols] report and proposed corrective action." The spokesperson did not return calls to 7 Eyewitness News for comment.
