The DEC regulations prohibit feeding deer because of the high risk of the spread of chonic wasting disease and other diseases. People who have bird feeders that attract deer are required by law to put a fence around the bird feeder.

To the person and their DEC regs...do you really think a fence will stop the deer if she/he wants that seed? Don't think so!

if the owner can't prevent the deer from accessing the feeder than the owner is required by law to remove the feeder. The owner doesn't have the option of allowing the deer to continue to feed on the bird seed.

Well if that's an actual (ridiculous!) law, then there are a TON of people in WNY who are unknowingly breaking it. Deer are everywhere and will do just about anything to find food. DEC might as well just ban bird feeders while they're at it.

what about the farmers who have fields of unharvested corn sitting out all winter. are they supposed to put a fence around that too so the deer keep out ?
