Today, the Bureau of Criminal Investigation arrested Kristofer M. Gregorek of Ballston Spa, NY for 2nd degree manslaughter.

Investigators determined Gregorek was shopping online on his cell phone when he rear-ended Volpe's Honda.

The 27-year-old was involved in the Thruway crash that killed UB Assistant Professor Dr. Ellen Volpe in Lancaster back in June.

Investigators say Dr. Ellen Volpe, 45, of Rochester was heading westbound on the I-90 around 9:45 a.m on June 8th, when her vehicle was hit from behind by a Freightliner box truck between exits 48a and 49.

The impact caused Volpe's 2009 Honda to strike several other vehicles.

Volpe was pronounced dead at the scene.

Gregorek will be arraigned at the Town of Lancaster Court.
