The man accused of smashing a Virgin Mary statue at a church in Buffalo will undergo a psychiatric evaluation.
The suspect smiled and waved at news cameras after his court appearance.
Police say 18-year-old Kalil Colbert destroyed the statue with a baseball bat and left a note inside the statue.
Judge Craig Hannah issued an issue of protection to the church to have him stay away in Buffalo City Court Wednesday morning. Colbert is due back in court May 29th.
Colbert is charged with aggravated harassment and a hate crime.
