BUFFALO, NY (WKBW) -- A Supreme Court Judge ruled Tuesday to return 40 horses to an East Aurora farm owner charged with animal cruelty.
SPCA investigators seized 73 horses from the farm of Beth Hoskins back in March where the animals were allegedly living in squalor. 53 cats and 4 dogs were also removed from the Emery Road farm.
The ruling also orders Hoskins to hire additional help to care for the animals, and allows the SPCA to inspect the horses on Hoskin's farm, provided they give thirty minutes notice.
Hoskins currently faces a number of animal cruelty charges, and the SPCA says they could file up to 100 additional charges later this month for each animal seized. The SPCA also wants Hoskins to pay more than $200,000 in expenses incurred while caring for the horses.
The horses could be returned to Hoskins as early as this week.
