Erie County Sheriff's Deputies Arrest Two Motorcyclists On DWI Charges

ERIE COUNTY, NY (WKBW/Erie County Sheriff's Office) - Erie County Sheriff Timothy B. Howard reports the arrest of two motorcyclists for DWI by Sheriff's Road Patrols late Tuesday night.

Deputies Rich O'Neil and John Hanna responded to a report of a motorcyclist who crashed into and went over the guard rail and went down the embankment on Warner Hill Road in the Town of Wales. Jacob M. Balon (30), of South Wales, was taken to ECMC via Mercy Flight for his injuries. He was subsequently charged for DWI. Blood draw done at the hospital BAC results yet to be determined.

Another motorcyclist David M. Yox (31), of Glenwood, was traveling behind Mr. Balon. As Wales Fire Company personnel were trying to rescue the injured rider Mr. Yox attempted to leave the area and was stopped by the Deputies. He was interviewed, given standard field sobriety tests and determined to be intoxicated. His BAC results were .13%. Both parties were given appearance tickets for Town of Wales Justice Court.
