The Buffalo Common Council member at the center of a state police investigation said he has not been offered a plea deal by the district attorney's office.
Brian Davis made the comment after Tuesday's council meeting as a group of reporters questioned him.
Eyewitness News asked Davis, "Have you been offered a plea deal by state police?"
"No comment." Davis replied, but then added, "No, I have not,"
He refused to answer additional questions as reporters followed him to his 14th floor office in city hall, including whether he has met with investigators.
Last week, Eyewitness News reported that authorities were looking to questions Davis, but were unable to locate him.
The New York State Police and Erie County District Attorney's Office have been investigating Davis for several months. They're looking into Davis' business dealings and his involvement in the failed Buffalo restaurant One Sunset.
One Sunset owner Leonard Stokes received more than $100,000 in city loans and grants, including a grant that was arranged by Davis.
Davis later paid for the struggling restaurant's rent, but his $3,500 check bounced, Eyewitness News was the first to report.
Frank Sedita, Erie County's district attorney, would not comment when asked if a plea deal has been offered to Davis.
A conviction to a misdemeanor or felony could force Davis to resign his post as representative of the Ellicott District, said Councilman David Rivera.
