Teacher Accused of Sexually Abusing Student Back in Court

50-year-old Allan Grogan appeared back in Newfane Town Court. Grogan, a former special education teacher at Newfane High School, was arrested last month and accused of having an inappropriate relationship with a student at the school. The former teacher is now facing a felony count of disseminating indecent material to a minor, two misdemeanor counts of endangering the welfare of a child, and four misdemeanor counts of sexual abuse.

"It's a big shock and we're disheartened by it," said Superintendent Gary Pogorzelski after the arrest in April. "We are working with the sheriff and doing everything we can to deal with the situation effectively."

Grogan waived his right to a felony hearing in Newfane Court tonight, and his case will now be moved to Niagara County Court.

"We've talked with several people who have worked with him throughout his history in teaching and he has received some positive endorsements," said William Berard III, who is representing Grogan. "They are all very good character references, and we're in the process of gathering them and providing them to the district attorney's office."

Grogan has resigned from the high school and remains free on $5,000 bail.
