Defense Rests in Accused Husband-Killer Trial

Robin Kalinowski claims the fatal shooting was an accident. In her first trial, which ended in a mistrial, she took the stand in her own defense. Her defense team though is playing it differently this time. Tuesday afternoon the defense rested without calling a single witness to testify. This time around the jury didn't get to hear firsthand from the Riverside woman who's accused of fatally shooting her husband in their bedroom back in November 2005. Her attorney, John Jordan, explains why they're going a different route now. "Part of the reason is her statement is in evidence -- what she said happened that night, and she also agreed to a videotape of the actions that night. That's in evidence," says Jordan, who admits there are also pitfalls to putting the defendant on the stand.

Earlier in the day prosecutors called to the witness stand a forensic firearms expert who testified his examination of the rifle used to kill Kevin Kalinowski turned up no defects that would cause it to fire unexpectedly. Kalinowski claims she was moving the rifle off the bed in their darkened room and it accidentally fired, killing Kevin.

The medical examiner served as the prosecution's final witness. He testified Robin Kalinowski's version of events does not mesh with the autopsy findings which he says show the barrel of the gun was in contact with Kevin's head when it fired, and he says the angle of entry is different than what Robin Kalinowski describes. He calls the shooting a "homicide", not an accident.

Now that both sides have rested it will be up to the jury to decide. Kevin Kalinowski's sister is hoping for a guilty verdict this time. "Witness after witness came forward throughout this whole trial to say she's guilty and she lied and she's manipulative and all of that played through in the district attorney's case," says Laurie Botwin, the victim's sister.

The attorneys will make their closing summations first thing Wednesday morning.
