Buffalo, N.Y. (WKBW) - A federal appeals court has denied a request
to put a Democratic congressional candidate on a third-party ballot
line in western New York.
Alice Kryzan - who beat Jon powers in the Democratic primary -
had sought to get her name instead of his on the Working Families
Party line. An extra ballot line is usually worth thousands more
votes, and Kryzan's race against Republican Chris Lee is a close
one.
The 2nd Circuit U.S. Court of Appeals on Monday declined to hear
Kryzan's appeal of a lower court's ruling giving the line to
Powers. In recent days, the ballot line has ping-ponged back and
forth between Kryzan and Lee as different state and federal judges
ruled on the matter. Monday's decision is almost certain to be the
final word on the subject.
