Alleged Copper Thieves Try To Use Political Clout

66 Pomona Place in South Buffalo, is a house that sits in a neighborhood where everybody knows everybody. The property was recently cleaned-up by they city and, according to Jody Herman the house is known for trouble. "When there was a drug bust in South Buffalo the downstairs tenants were involved in that." she said.

Police say two men, Charles and Joseph Frohnheiser were allegedly caught trying to steal copper pipes from the basement of that home Tuesday night. According to police, during the arrest one said, "You can't arrest me I work for councilman Mickey Kearns". 7 News went to Kearns directly who wanted clear his name. "He's no association to me. He doesn't work in my office. He's not on my pay-roll. I'm glad the Buffalo Police did a good job. I just want to set the record straight that he is not an employee in my office." said Kearns.

Kearns doesn't know why his name was used, but council majority leader Richard Fontana backs up Kearn's claim. He says both men worked for the city at one point or another, but never directly for Kearns. Their employment with the City of Buffalo, he says, is now over. But according to Fontana the battle over the Queen City's copper is just beginning. "Our municipal buildings, some restaurants have been hit over the past couple of months and it's a real burdensome task for the homeowners to replace all pipes." said Fontana.

Both men are now facing charges that include burglary and possession of stolen property.
